Terms of Service

1. Acceptance of Terms
By downloading, installing, or using the Calam application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Calam.
2. Description of Service
Calam provides Voice over Internet Protocol (VoIP) calling services that allow you to make outbound voice calls over WiFi or mobile data connections.
Important: Calam is not a replacement for traditional mobile or landline phone service. The service requires an active internet connection and may not be available in all locations or at all times.
3. Account Registration
To use Calam, you must:
- Be at least 18 years of age
- Provide a valid mobile phone number for verification
- Maintain the confidentiality of your account credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access or security breach at support@calam.app
We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.
4. Payments, Credits, and Billing
Calam operates on a prepaid credit system:
- Credits must be purchased before making calls
- Call rates vary by destination and are displayed in the App
- Credits are non-transferable between accounts
- Purchased credits do not expire
Call Billing
Calls are billed in 60-second (one-minute) increments, rounded up to the nearest minute. For example, a call lasting 1 minute and 5 seconds will be billed as 2 minutes.
Rate Changes
Call rates displayed in the App are subject to change without prior notice due to:
- Wholesale pricing changes from our telecommunications partners
- Currency fluctuations
- Regulatory changes in destination countries
- Changes to interconnection agreements
New rates apply to all calls made after the change. We recommend checking current rates in the App before making calls. Any credits you have purchased retain their monetary value—only per-minute rates may change.
Data Charges
Calam uses your internet connection (WiFi or mobile data) to make calls. Your mobile carrier may charge for data usage. Please check with your carrier for applicable data rates, especially when roaming internationally.
5. Refund Policy
Unused credits may be refunded within 30 days of purchase, less any credits used. To request a refund, contact us at support@calam.app.
Refund Exceptions
Refunds will not be processed in the following circumstances:
- Suspected fraudulent activity on the account
- Abuse of the refund policy (e.g., repeated refund requests for same or similar purchases)
- Credits used for completed calls, regardless of perceived call quality
- Account termination due to Terms of Service violation
- Refund requests made more than 30 days after purchase
Quality Issues
If you experience consistently poor call quality, please contact support within 7 days of the issue. We will investigate and may offer credit compensation for documented service failures attributable to our systems. Quality issues caused by your internet connection, device, or third-party networks are not eligible for compensation.
Processing Time
Approved refunds will be processed within 14 business days to the original payment method. Depending on your bank or payment provider, the refund may take additional time to appear in your account.
6. Acceptable Use Policy
You agree not to use Calam to:
Prohibited Communications
- Make harassing, threatening, abusive, or defamatory calls
- Engage in telemarketing, spam calling, or robocalling
- Impersonate any person or entity
- Make calls that violate do-not-call registries or similar regulations
- Engage in "wangiri" or callback fraud schemes
- Make debt collection calls that violate applicable regulations
Commercial and Technical Abuse
- Operate call centers or telemarketing operations without prior written authorization from Calam
- Resell, redistribute, or commercially exploit the service or minutes/credits to third parties
- Use the service through GSM gateways or SIM boxes
- Generate artificial traffic or inflate call volumes
- Use VPN connections or proxy services in ways that trigger our fraud detection systems (your account may be automatically suspended)
- Attempt to bypass geographic restrictions or pricing structures
- Use auto-dialers, predictive dialers, or similar technologies without authorization
- Interfere with or disrupt our services, servers, or networks
- Attempt to circumvent any security measures or access controls
Legal Compliance
- Violate any applicable local, national, or international laws or regulations
- Use the service for any unlawful purpose
- Facilitate or promote illegal activities
Fair Use
Calam is designed for personal, non-commercial use. Accounts showing unusual patterns may be reviewed and suspended pending investigation. Unusual patterns include but are not limited to:
- Extremely high call volumes inconsistent with personal use
- Calls to a disproportionate number of countries in rapid succession
- Calls primarily to premium-rate numbers or known fraud destinations
- Patterns consistent with commercial call center operations
Call Recording
Some jurisdictions require all-party consent before recording calls. If you record calls made through Calam, you are solely responsible for complying with all applicable laws regarding recording consent. Calam does not record your calls and is not responsible for any recordings you make.
Violation of this Acceptable Use Policy may result in immediate account suspension or termination without refund.
7. VoIP Restrictions by Country
Legal Restrictions
The use of VoIP services like Calam may be restricted, regulated, or prohibited in certain countries. You are solely responsible for ensuring your use of Calam complies with local laws in your location and the destination you are calling.
Countries and regions known to have VoIP restrictions or bans include (but are not limited to):
- United Arab Emirates
- Saudi Arabia
- Oman
- Qatar
- Kuwait
- China (may require government-approved VPN)
- North Korea
- Cuba
- Egypt (partial restrictions)
- Morocco (partial restrictions)
This list may not be current or comprehensive. VoIP regulations change frequently. Please verify local regulations before using Calam in any country.
Carrier Restrictions
Your mobile carrier may:
- Throttle or block VoIP traffic on their network
- Charge additional fees for data used for VoIP calls
- Impose fair use policies that affect VoIP usage
- Throttle VoIP traffic, resulting in degraded call quality
Please check with your mobile provider regarding their policies on VoIP applications.
Roaming Considerations
When using Calam while roaming internationally:
- Data charges from your mobile carrier may apply and can be significant
- VoIP quality depends on local network conditions which may vary
- Some countries may block or throttle VoIP traffic at the network level
- Hotel and public WiFi networks may block VoIP services
Your Responsibility
Calam is not responsible for any consequences arising from your use of the service in jurisdictions where VoIP is restricted or prohibited. This includes but is not limited to fines, penalties, legal action, or service unavailability.
8. Caller ID Limitations
Important: Calam does not currently support Caller ID (CLI) transmission. When you make calls through Calam:
- Your personal phone number will not be displayed to the recipient
- Recipients may see "Private Number," "Unknown," or a different number
- Recipients will not be able to call you back directly using the displayed number
This limitation exists due to technical and regulatory constraints in international VoIP routing. We may introduce Caller ID features in the future, and any such changes will be communicated through the App.
If recipients need to reach you, you must provide them with your phone number verbally during the call or through other means.
9. Emergency Services
Important: Calam is a VoIP service and cannot be used to call emergency services (such as 999, 112, 911, 000, or any local emergency numbers). Emergency calls require location data and direct network connections that VoIP technology cannot reliably provide.
You must maintain an alternative means of accessing emergency services, such as a traditional landline or mobile phone service. Do not rely on Calam for emergency situations.
10. Service Limitations
Please be aware that:
- Calam requires an active internet connection to function
- Call quality depends on the speed and stability of your network connection
- Calam is not a replacement for traditional phone service
- Caller ID is not currently supported (see Section 8)
- Service availability may vary by region
- We rely on third-party telecommunications providers who may impose additional limitations
- Calls to certain destinations may be unavailable or restricted
11. Service Suspension and Interruption
We may suspend, restrict, or interrupt access to the Service without prior notice under the following circumstances:
- Scheduled or emergency maintenance
- Suspected fraudulent activity or breach of these Terms
- Violation of the Acceptable Use Policy
- Government or regulatory orders
- Network security threats
- Non-payment or suspected payment fraud
- Force majeure events (see Section 17)
12. Software License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a device you own or control, solely for personal, non-commercial purposes.
You may not:
- Copy, modify, or distribute the App
- Reverse engineer, decompile, or disassemble the App
- Rent, lease, lend, sell, or sublicense the App
- Remove any proprietary notices or labels
- Use the App to create a competing product or service
13. Intellectual Property
The Calam application, including all content, features, functionality, trademarks, logos, and service marks, is owned by Calam and protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted are reserved.
14. Privacy
Your use of Calam is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to the collection and use of information as described in the Privacy Policy.
15. Third-Party Services
Our service relies on third-party telecommunications and infrastructure providers. We are not responsible for:
- Service interruptions caused by third-party providers
- Quality issues arising from third-party networks
- Restrictions imposed by destination country carriers
- Any actions taken by your mobile carrier
- VoIP blocking or throttling by third-party networks
16. Disclaimer of Warranties
Calam is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that:
- The service will be uninterrupted or error-free
- Calls will always connect successfully
- Call quality will meet any particular standard
- The service will be available at all times or in all locations
- Caller ID will be displayed to recipients (not currently supported)
- Defects will be corrected
17. Limitation of Liability
To the maximum extent permitted by applicable law:
- Calam shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service
- Our total liability for any claims arising from or related to the service shall not exceed the greater of: (a) €50, or (b) the total amount you paid to Calam in the six (6) months preceding the claim
- We are not liable for lost profits, data loss, business interruption, or any damages resulting from failed or dropped calls
- We are not liable for any consequences arising from VoIP limitations in your jurisdiction
- We are not liable for any inability to reach emergency services through Calam
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
18. Indemnification
You agree to indemnify, defend, and hold harmless Calam and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and costs and expenses (including reasonable legal fees) arising from:
- Your use of the App or Service
- Your violation of these Terms
- Your violation of any applicable laws or regulations
- Your violation of any third-party rights
- Your use of the service in jurisdictions where VoIP is restricted
19. Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from events beyond our reasonable control, including but not limited to:
- Natural disasters, epidemics, or pandemics
- War, terrorism, or civil unrest
- Government actions or regulations
- Power outages or telecommunications failures
- Internet service provider failures
- Cyber attacks or security incidents
20. Changes to Terms
We may modify these Terms at any time. For material changes, we will provide at least 30 days' notice through the App or via email to your registered email address. Minor changes may take effect immediately upon posting.
Your continued use of Calam after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the service and may request a refund of unused credits (subject to Section 5).
21. Termination
Termination by You: You may stop using Calam and close your account at any time by contacting us at support@calam.app or through the App settings.
Termination by Us: We may suspend or terminate your access immediately and without notice if:
- You have violated these Terms or the Acceptable Use Policy
- We suspect fraudulent or illegal activity
- We are required to do so by law or regulatory order
Upon termination, any unused credits may be refunded at our discretion, except in cases of termination for violation, fraud, or Acceptable Use Policy breach.
22. Dispute Resolution
If you have a dispute with Calam, we encourage you to contact us first at support@calam.app to seek a resolution. We will make reasonable efforts to resolve any disputes informally within 30 days.
If we cannot resolve the dispute informally, both parties agree that any legal proceedings will be conducted in the courts of Ireland.
23. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods shall not apply.
24. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
25. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
26. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Calam regarding the use of the Service and supersede all prior agreements and understandings, whether written or oral.
